In general, for an entity to have legal capacity to sue or be sued, it must be recognized as a legal entity or have legal personality under the jurisdiction’s laws. As the legal status of DAOs is uncertain under Polish law, it is unclear whether a DAO would be recognized as having the legal capacity to participate in legal proceedings.
