Can a DAO be sued or bring a lawsuit in a court of law?

Select jurisdiction

  • Poland

The ability of a DAO to be sued or bring a lawsuit in a court of law in Polish jurisdiction is uncertain, as DAOs are a relatively new concept and have not been explicitly regulated under Polish law.

In general, for an entity to have legal capacity to sue or be sued, it must be recognized as a legal entity or have legal personality under the jurisdiction’s laws. As the legal status of DAOs is uncertain under Polish law, it is unclear whether a DAO would be recognized as having the legal capacity to participate in legal proceedings.
