Can a DAO hold a patent or trademark?

France

NO.

Registration for trademarks or patents may only be made by physical persons or legal entities with legal capacity (registered at the Company Names or Association Registrars). DAOs do not have legal capacity.

If the entity is not legally constituted and registered, it may not own assets per se so may not hold a trademark/patent.

Because of the lack of legal capacity or the legal inferences that my be made with regard to « sociétés de fait » – « sociétés en participation » or « fiducie » (trusts), DAOs tend to found a corresponding company/association.
